Welcome to the Timber Oaks Home Design website (the "Website"), located at www.timberoaksdesign.ca. These terms and conditions ("Terms") govern your use of our Website and the services we offer. By accessing or using our Website, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Website.

1. Introduction

Timber Oaks Home Design ("we," "us," or "our") provides custom home design and architectural design services. Our services include, but are not limited to, new builds, additions, renovations, timber frame design, and barndominiums. These Terms apply to all visitors, users, and others who access or use the Website.

2. Use of Our Website

You agree to use our Website only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Website. Prohibited behavior includes harassing or causing distress or inconvenience to any other user, transmitting obscene or offensive content, or disrupting the normal flow of dialogue within our Website.

3. Intellectual Property

The content on this Website, including but not limited to text, graphics, logos, images, and the compilation thereof, and any software used on the site, is the property of Timber Oaks Home Design or its suppliers and is protected by copyright and other intellectual property laws. You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Website or its content without express written permission from us.

4. Our Services

Timber Oaks Home Design offers a range of architectural design services. All services are subject to a separate agreement that will be provided to you before the commencement of any work. This agreement will outline the scope of work, fees, timelines, and other important terms.

5. Design Process

Our design process is structured in phases as outlined on our Website. Each phase will have specific deliverables and will require your approval before we proceed to the next phase.

6. Payments

Fees for our services will be detailed in your individual service agreement. We may require a deposit before beginning work, with subsequent payments due at the completion of specific milestones. All payments must be made in accordance with the terms of the service agreement.

7. Client Responsibilities

As a client, you agree to provide us with accurate and complete information and to cooperate with us in a timely manner. Delays in providing feedback or necessary information may impact project timelines.

8. Limitation of Liability

To the fullest extent permitted by law, Timber Oaks Home Design shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Website; (b) any conduct or content of any third party on the Website; (c) any content obtained from the Website; and (d) unauthorized access, use, or alteration of your transmissions or content.

9. Links to Other Websites

Our Website may contain links to third-party websites or services that are not owned or controlled by Timber Oaks Home Design. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

10. Purchasing pre-drawn Plans

a) Please be certain that the plan you have selected suits your needs as all sales are final. No refunds or exchanges.

b) All house plans from Architectural Designs are designed to comply with the International Residential Code (IRC) and to the local codes in the area where the designer resides or where the house was built.

c) Every province, county or municipality will have its own building and code requirements. It is possible that your plan may need to be modified to comply with these local requirements. This is particularly true in coastal areas and those facing seismic events, extreme winds and heavy snow. If you are building in any of these areas, it is likely that a licensed structural engineer will be needed to provide the necessary calculations and additional drawings. We authorise the use of our plans conditioned on your obligation and agreement to strictly comply with all local building codes, ordinances, regulations and requirements, including permits and inspections at the time of and during construction. We recommend checking with your local building department for the most current requirements.

d) All pre-drawn plans from Timber Oaks Home Design do not carry a stamp from a licensed architect. If this is a requirement from your local building department, you will need to hire an engineer to review and stamp the plans.

e) The original designer retains title and ownership of all plans. The original designer, as the Licensor, grants you, as Licensee, the right to use these plans to construct a single structure. All of our plans are protected under the Copyright Act (R.S.C., 1985, c. C-42). The plans licensed to you cannot be used or resold to another individual. These plans cannot be copied or reproduced by any means unless specifically authorized.

f) When you use Timber Oaks Home Design, or send e-mails, text messages, and other communications from your desktop or mobile device to us, you may be communicating with us electronically. You consent to receive communications (including marketing communications, unless you have opted-out where applicable) from us electronically, such as e-mails, texts, mobile push notices, or notices and messages on this site or through other Timber Oaks Home Design services. You agree that all notices, disclosures, agreements, and other communications that we provide to you electronically satisfy any legal requirement that such communication be in writing.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
